Kinshasa, April 3rd, 2025 (CPA) – The High Military Court of the Democratic Republic of Congo has postponed to a later date the trial of general of the brigades John Dibwe, prosecuted for desertion in a foreign country and violation of orders, it was learned on Wednesday from a judicial source.
It was planned to the hearing today the investigation of the merits of the case.
At the last hearing, the High Military Court had rejected the defence’s single submission, which was for ‘annulment of the proceedings prior to the appearance of the defendant on the grounds that he has never been arrested, but rather abducted on the night of February 2nd to 3rd, 2022 at 1 a.m. by the members of the Zambian police and the Congolese army’.
The application had been rejected in the preliminary ruling handed down by the High Military Court.
A preliminary ruling is one in which the judge orders a preliminary measure intended either to investigate the claim or to settle an incident relating to such a measure, or to provisionally settle the situation of the parties,’ it notes.
